1. General Terms and Condition

This agreement establishes the terms and conditions for the Internet service and telephony (Voice over Internet Protocol – VoIP) (hereinafter referred to as “Services” to a subscriber). Use of the Registration form or use of the services constitutes the agreement to the terms and conditions stated below.

2. Usage

The customer is the only one responsible for any access to his account. The services must only be used for legal purposes. The following acts constitute an offense: copyright, material deemed obscene, confidential material or threatening electronic communications. If such an act is committed, the Supplier will provide all relevant information to the authorities in order to facilitate the legal proceedings. Any attempt to introduce any unlawful act in our system will result in an immediate closure of the account without notice. The customer is limited to one connection to the internet at a time. The customer is not allowed to share the service with others.

3. Internet service connection and speed

After Colba.Net had taken your contact information and subscription, Colba.Net will send you an official contract by email. To accept the contract, the customer must choose the date of installation and accept the terms and conditions. The delay for the internet connection is one to two weeks.

4. Technical support and customer’s equipment

The Supplier makes available to the customer a technical support service which is made available by phone 7 days a week for problems directly related to the Internet access, excluding the equipment that is the property of the customer. The most frequently encountered problems that are the responsibility of the customer are outlined below:

i) Viruses, which can affect the operation of your computer,
ii) A misconfigured router,
iii) A weak ‘WIFI’ wireless signal due to problematic frequencies or possible interferences

The customer must first check the operating status of his computer. In addition, the Supplier cannot provide technical support for the router that the customer has purchased and not supplied by Colba.Net because due to the numerous models of routers on the Market.  In addition, it will be very difficult to give support by phone without knowing the configuration and type of interface of the equipment if it has not been supplied by Colba.Net. The Supplier will guarantee the Internet access to the demarcation point (the point of connection between the telecommunication network and the indoor wiring), which is generally located outside the building. From the demarcation point the customer is responsible for the good working condition of the interior wiring. The supplier is not held responsible for the customer’s equipment and the internal wiring of the customers home or business.

5. Fees for ColbaNet and / or Bell and / or Videotron technician

In the case of service failure, the customer has the obligation to immediately notify the Supplier and describe the problem encountered. The customer must ensure that his equipment and / or internal wiring are not defective. If the problem cannot be solved by telephone, the Supplier will send a technician with an advance payment of $ 92.87, plus tax, which will be refunded if the problem has not been caused by the user. This charge of $ 92.87 is charged by ColbaNet to cover the cost of the technician’s travel to the customer location in the case that the problem has been caused by the customer.

6. Cancellation and Refund Policy

You can cancel the service by sending an email to account@colbanet.ca. If your contract is for a fixed term, the indemnity payable by the user will be equivalent to 10% of the residual economic value of the contract. For any business contract of one year or more the client may terminate upon payment equal to 50% of the residual value of the contract.

7. Modification to the Pricing

The cost of the service may change within a 30 days’ notice.

8. Terms of payment and additional fees

The customer can pay his invoice, after the initial subscription on our website (https://www.colba.net/) in the billing section with a credit card, Visa debit card or MasterCard debit card. The customer can send a cheque, or pay by Interac at our office during business hours. The customer acknowledges that the payment is made at the beginning of his billing period as stated in the contract. Any cheque that is refused will incur an additional charge of $30.00. Failure to pay fees and/or monthly payments when they are due may result in an immediate suspension of the service. In addition, the client will incur a $20.00 administration fee for all requests made in regards to change to the username or for a transfer of responsibility to another person and or business.

9. Resale and distribution prohibited

It is prohibited to resell, redistribute or use the service for any purpose other than private usage. A failure to do so will result in the cancellation of your service or services.

10. Security and Confidentiality

It is important to adequately protect your computer from theft, unauthorized use, or corruption. It is recommended not to use the service for the transmission of confidential data. The Supplier cannot ensure or guarantee the confidentiality and cannot be held responsible for corrupt files or other damages in this respect.

11. Monthly usage limit (download and upload)

When you reach 80% of your monthly data transfer limit you will be notified by email. You will be able to purchase an additional 300 GB block of usage for the current month for $ 10.00 payable in advance on your online account. The 1 Terabyte service is equal to 1024 GB

If the service does not mention “1 TB” or “1 Terabyte”, it has unlimited internet.

12. No warranty on the Service and limitation of liability

The Supplier will commit to a limited obligation and is not responsible for, in particular, the decrease of service, the breakdowns, the interruptions of service, the loss of data or contents, if these actions are not a result of the supplier.

13. Delivery method of equipment

For a fee of $15.00 the customer can receive his equipment through a courier service (Purolator).
